JOURNAL NEWS: Yonkers woman sues over alleged rape by her cop husband, false arrest


PHOTO: Marlaina Koller-Gurgigno has sued her estranged husband, Yonkers police officer Vincent Gurgigno Jr., several of his colleagues, the city and police department. She alleges that Gurgigno forcibly raped her, that his fellow officers later falsely arrested her and that the city had violated her civil rights and failed to adequately train and supervise her husband and the other officers.

A Yonkers woman suing the city and its Police Department claims she was raped last year by her estranged husband, a Yonkers police officer, and later falsely arrested by his colleagues.

The lawsuit by Marlaina Koller-Gurgigno contends that she was the victim of multiple incidents of domestic violence by Officer Vincent Gurgigno Jr. and that his colleagues were aware of them and did nothing to protect her.

“That makes people afraid and she doesn’t deserve to be afraid,” said her lawyer, John Hannigan. “Their first duty is to protect the people of Yonkers and not their fellow officer.”

Koller-Gurgigno, 39, is seeking unspecified monetary damages for claims including violation of her civil rights, forcible rape, false arrest and infliction of emotional distress. The lawsuit was filed in late October in state Supreme Court in White Plains. Hannigan said it was served on the defendants Thursday......
