PRESS RELEASE: Appeals Court Upholds Yonkers Vehicular Manslaughter Conviction


WHITE PLAINS – The Appellate Division of State Supreme Court has upheld a May 2016 conviction of a Yonkers man in connection with the death of a passenger in the car he was driving.


Antoine Simmons, now 37, was driving in Yonkers early in the morning on October 19, 2014 when he slammed into a tree. His passenger, Beverly Simmons, 28, no relation to him, was killed.

Simmons was sentenced to 3 ½ to seven years in state prison after being convicted in Westchester County Court of vehicular manslaughter, criminally negligent homicide, driving while ability impaired by drugs, reckless driving and aggravated unlicensed operation of a motor vehicle. 
He was found to have PCP and marijuana in his system.

Simmons chose to represent himself at his trial in Westchester County Court.

His recent challenge to his conviction was rejected as the court affirmed it.
